Nancy Pelosi of California and Democratic Sen. Chuck Schumer of New York should “step aside” following Vice President Kamala Harris’ defeat in the presidential election.

The union announced in September it would make no endorsement in the election, even though President-elect Donald Trump received overwhelming support in electronic and phone surveys of the rank-and-file members of the Teamsters. O’Brien said he stood by that decision when asked by “Your World” host Neil Cavuto.

“The polling that we did was extensive. Obviously, it went towards President Trump but we still got a large contingency that are still Democrat, vote Democrat,” O’Brien said. “The decision we made as a general executive board, I’ll stand by it. The good news is that, the Democrats have an opportunity to refocus and try to reclaim why they lost the working class and the Republicans have been saying they want to be the working-class people. So, it’s a great opportunity for both sides, especially Republican, to prove that. We have a lot of issues we need to get resolved in this country, and we have got to do it.”

Cavuto noted O’Brien didn’t speak at the Democratic convention in August after he addressed the Republican convention in July. O’Brien said he wanted elected officials to “take care of the working people.”

“We want results, not excuses,” O’Brien said. “And look, the great part about this process is we have four more years. If people don’t, on either side, live up to their promises and/or fix their problems, we’ve got four years to build a machine to get the right people in there that will make the right decisions.”

O’Brien also took aim at Democratic leaders, saying they were too focused on “social issues” during an “Economic election.”

“At the end of the day, a lot of these issues are important but what is more important is providing an opportunity for your family, putting food on the table, saving some money and living the American dream. So, they have got a lot of soul-searching to do,” O’Brien said. “I said this earlier today in another interview, the Democrat Party needs to take a look in the mirror and say maybe Chuck Schumer’s time is over, maybe … Pelosi’s time is over. Let’s figure out who is going to be the best for the party.”

“As an organization, we are always looking at how do we leave this organization better than we found it. I think that needs to be the focus,” O’Brien added. “Look, we all have pensions for a reason. That’s to use them to retire and enjoy life. Maybe they should take a page out of Joe Biden’s book and step aside.”

Days after President Joe Biden called for a constitutional amendment making it clear “no President is above the law or immune from prosecution for crimes committed while in office,” Democratic Senate Majority Leader Chuck Schumer introduced a bill that aims to reverse the Supreme Court’s presidential immunity ruling. Schumer’s “No Kings Act” introduced on Thursday doesn’t stop with reversing the Supreme Court’s decision, but would strip the Supreme Court of jurisdiction to even consider challenges to prosecuting a former president for alleged crimes related to official acts, along with challenges to the bill itself.

“None of that is constitutional,” Ilya Shapiro, senior fellow and director of constitutional studies at the Manhattan Institute, told the DCNF in reference to the provisions of Schumer’s bill.

Shapiro said both Schumer’s bill and Biden’s proposal for an amendment are “making too much” of Chief Justice John Roberts’ majority opinion.

“It’s a reasonable and fairly narrow decision,” he said. “The outcry about it is either disingenuous or just not understanding the law.”

The Supreme Court held on July 1 that presidents have immunity from criminal prosecution for “official acts” taken in office. The majority opinion left the task of analyzing which allegations in former President Donald Trump’s indictment are official acts subject to immunity for the lower courts.

John Yoo, University of California, Berkeley law school professor, told the DCNF that “the call to override the Court on the presidential immunity decision is part and parcel of Kamala Harris’s progressive assault on the Constitution.”

“Overruling the Court — through unconstitutional means such as a statute — show the disregard progressives hold for a co-equal branch of government,” Yoo said. “It fits with the call to place term limits on the Justices, which Biden proposes and Harris supports, or even to pack the Court, which Harris called for in 2020. It is an obvious threat, even if it never passes, against the Court simply because progressives disagree with the Court’s interpretation of the Constitution.”

Vote line-ups from the past term conflict with Democrats’ narrative that the Supreme Court is “out of control.”

Several high-profile cases, including challenges to the abortion pill and former president Donald Trump’s eligibility for the 2024 ballot, ended in unanimous rulings. Just half of the 22 decisions that split 6-3 were divided along expected ideological lines, with the Republican-appointed justices on one side and the Democrat appointees on the other, according to Empirical SCOTUS.

Cornell Law School professor William Jacobson told the Daily Caller News Foundation the bill is just “the latest salvo in the Democrats’ war on the Supreme Court.”

“If Democrats want to abolish presidential immunity, they cannot do so retroactively, but could try to pass a prospective constitutional amendment,” Jacobson told the DCNF. “Recognizing the unlikelihood of a constitutional amendment, Schumer seeks an end run by trying to limit the right to appeal to the Supreme Court. Whether that work-around is viable remains to be seen, but there is nothing principled about it.”

Biden proposed on Monday implementing term limits for justices, passing a binding code of ethics and enacting a constitutional amendment clarifying presidents do not have immunity from prosecution for official acts.

Since Schumer’s bill would limit the Supreme Court’s jurisdiction, South Texas College of Law Houston professor Josh Blackman highlighted in Reason that “a conviction of the President of the United States would stop with the inferior courts, and most likely, the D.C. Circuit, which by the way, will have a Democratic-appointed majority for at least the next two decades or so.”

Blackman noted the bill stands “no chance” of passing in the current Congress, but could pass if Vice President Kamala Harris wins the election and Democrats take majorities in both houses.

“Once the Supreme Court’s jurisdiction is stripped for presidential immunity, it is only a matter of time before similar bills are passed for abortion, the Second Amendment, RFRA, and so on,” Blackman wrote. “This bottomless hole keeps going deeper.”

During an interview on air at the Republican National Convention in Milwaukee, Wisconsin, Karl discussed the “intensifying” pressure that has been building against Biden since his poor debate performance against former President Donald Trump in late June. Karl stated that within a private one-on-one meeting Saturday between the Democratic Senate Leader and Biden, Schumer allegedly “made the case” for the president to step aside as the nominee.

“I am told that the pressure from Democratic leaders for Biden to get out of the race is intensifying. In fact, one person who has been out there publicly defending Biden told me just a short while ago, Biden is going to see the whole house of cards come down soon,” Karl said. “As for that meeting in Rehoboth, Delaware, I am told that this was a one-on-one meeting just the Senate Leader and the president. And that Chuck Schumer forcefully made the case that it would be better for Biden, better for the Democratic Party and better for the country if he were to bow out of the race.”

The White House told the Daily Caller News Foundation that it has no intention of changing its course, and Biden will remain as nominee heading into November.

“The President told both leaders he is the nominee of the party, he plans to win, and looks forward to working with both of them to pass his 100 days agenda to help working families,” White House spokesperson Andrew Bates told the DCNF.

While details weren’t given to the ABC News host, Schumer’s office reportedly told him that the Democratic leader expressed the “views of his caucus.” Karl additionally stated that Democratic House Leader Hakeem Jeffries has also “expressed similar views” to Biden.

“When I went to Schumer’s office to tell them I was going to report this and tell you this tonight, absolutely no denial from Senator Schumer’s office. They only said this, ‘Leader Schumer conveyed the views of his caucus.’ In other words, the views of Democratic senators. I am also told that Hakeem Jeffries, the Democratic leader in the House, has expressed similar views directly to the president,” Karl continued.

Jeffries previously confirmed his meeting with Biden on July 12, telling fellow lawmakers how he “directly expressed the full breadth of insight, heartfelt perspectives and conclusions about the path forward that the Caucus has shared in our recent time together,” according to a dear colleague letter sent by his office.

Concerns for Biden remaining as the nominee began to circulate late June, with a growing list of Democrats in both the House and Senate vocalizing their stances on having the president step aside. The calls against Biden came after he noticeably struggled to finish his statements during his debate performance, and at one point freezing mid-statement.

Despite his continuous gaffes while speaking and the calls from lawmakers, Biden and his campaign have remained firm in staying in the race. During an interview with BET on Wednesday, Biden stated he would only be open to dropping the race if he develops a medical condition or if doctors suggest he should exit.

In addition to concerns from politicians, a post-debate CBS/YouGov poll found 72% of Americans no longer believe the president has the mental and cognitive health to remain in office, jumping up seven points since their last survey in early June.

Schumer’s office did not immediately respond to the DCNF’s request for a comment.

The first article claimed that Mayorkas had “willfully and systematically refused to comply with the law” regarding the southern border during his tenure as DHS Secretary. The second article alleged that he had violated public trust.

Majority Leader Chuck Schumer, D-N.Y., proposed a point of order to deem the first article unconstitutional. Following Schumer’s proposal, the Senate voted 51-48 to declare it unconstitutional, with Sen. Lisa Murkowski, R-Alaska, voting present.

Schumer’s point of order was introduced after his request for unanimous consent, which would have set a specific time for debate among senators and votes on two GOP resolutions and a set number of agreed-upon points of order, was denied by Sen. Eric Schmitt, R-Mo. Republican senators opposed Schumer’s point of order, as agreeing to it would effectively nullify the first article. Several GOP lawmakers made motions, including requests to adjourn or table the point of order, but all were unsuccessful.

“This process must not be abused. It must not be short-circuited. History will not judge this moment well,” said Senate Minority Leader Mitch McConnell, R-Ky., as he motioned to table Schumer’s point of order.

After further motions to avoid voting on Schumer’s second point of order, which would declare the second article unconstitutional, the Senate agreed to it in a 51-49 vote, with Murkowski rejoining the Republicans.

Tommy Tuberville, R-Ala., for holding back the confirmation of President Joe Biden’s military appointees, yet on Thursday, Schumer tacitly admitted that Tuberville isn’t the problem—the Democrats’ own priorities are.

Tuberville has put a “hold” on Biden’s military nominees, protesting the Department of Defense’s policy offering taxpayer funds to pay for service members’ travel expenses when they seek to get abortions. This means he objects to “unanimous consent,” the process by which the Senate rubber-stamps an entire bloc of nominees without a recorded vote. It does not mean Tuberville is single-handedly preventing the Senate from voting on the nominees individually, as Democrats like Schumer appear to suggest.

On Thursday, Schumer celebrated the fact that the Senate has confirmed over 140 of Biden’s judicial nominees. By celebrating this, the Democrat tacitly admitted that he prioritized judges over military personnel, Tuberville and other Republicans argued.

“Sen. Schumer is all talk,” Tuberville told The Daily Signal in a statement Thursday. “He is bragging about how many judges he has confirmed while refusing to bring a single military nomination to the floor. If he was really concerned about readiness, he would call a vote today.”

“My position has not changed. I will continue to hold nominees until Biden reverses his illegal taxpayer-funded abortion travel policy,” the senator added.

Sen. Mike Lee, R-Utah, characterized Schumer’s tweet as saying “the quiet part out loud.”

“He can pass any nominations he wants, he simply refuses to bring up military promotions for a vote!” Lee added.

Sen. Ron Johnson, R-Wis., condemned Democrats like Schumer as “complete hypocrites,” urging them to rescind the Department of Defense’s “illegal policy of funding abortions with taxpayer” funds.

“If they want to confirm a general, they can bring the nominee up for a vote,” Johnson added.

“The Senate didn’t vote today,” Tuberville noted Wednesday. “We’ve had 80 days off this year. Plus weekends. And [Schumer] wants to lecture me about nominations?”

Schumer has repeatedly condemned the Alabama senator’s move, calling it “dangerous and reckless.”

“Sen. Tuberville’s indefinite hold on the confirmation of our general and flag officers is reckless, unprecedented, harmful to our military’s readiness, and sends the wrong message to our partners and allies,” Schumer said in May. He cited a letter from Secretary of Defense Lloyd Austin claiming that Tuberville’s hold poses a “clear risk” to military readiness.

Schumer did not respond to The Daily Signal’s request for comment on whether his celebration of judicial confirmations undermines his attempts to blame Tuberville for the confirmation delays.

The Washington Examiner’s Conn Carroll, a former Senate staffer, wrote that Democrats could have approved 108 military promotions if they worked an eight-hour day five days a week instead of leaving town for a month this summer.

John Aquilino, commander of U.S. Indo-Pacific Command, said during a Senate Armed Services Committee hearing that Tuberville’s holds are having “no impact” on operations.

Critics have condemned many of Biden’s military nominees as “woke,” citing their advocacy for liberal issues such as gun control and their warnings about “white colonels” being the “biggest barriers” to “racial justice.” Schumer may be attempting to protect vulnerable Democratic senators from taking on-the-record votes for divisive nominees.

The bill passed 68-29. Since there are 47 Democrats in the Senate and 3 Independents who caucus with Democrats, at least 18 Republicans voted to support the package.

Conservatives called the move during the lame-duck session a “stunning act of betrayal.” Democrats have had both branches of Congress and the presidency during all of 2022, conservatives say, but rushed to pass this budget bill only after Republicans won a House majority in November.

Since 1994, the House majority has changed four times. In each case, the outgoing majority didn’t pass an omnibus appropriations bill during the lame-duck session following the election. In each case, the outgoing majority left the hard work of legislating to the representatives the American people had just elected.

Rep. James Comer, R-Ky., incoming chairman of the House Oversight and Reform Committee, warned that Republicans would be voluntarily abandoning their ability to hold the Biden administration accountable for the next year.

The omnibus bill would fund the government through September 2023. It includes military funding for Ukraine, a ban on the Chinese-owned TikTok app on federal government devices, and millions in funding for “woke” earmarks such as LGBTQIA+ Pride Centers, a Michele Obama Trail in Georgia, and the TransLatin@ Coalition. The spending bill does not include the Hyde Amendment, which prohibits federal tax dollars from going to fund elective abortions.

Wall Street Journal columnist Kimberley Strassel noted that the omnibus package includes “dozens of pieces of stand-alone legislation” on issues such as retirement, public lands management, health care policy, electoral count reform, and aviation rules.

Although the House and Senate appropriations committees state that the omnibus bill would cost $1.7 trillion, Richard Stern, a senior policy analyst for budget policy at The Heritage Foundation, says the bill would cost at least $1.85 trillion in fiscal year 2023, which began Oct. 1. Senate Minority Leader Mitch McConnell, R-Ky., defended the spending bill.

“Providing assistance for Ukrainians to defeat the Russians is the number one priority for the United States right now according to most Republicans,” McConnell said. “That’s how we see the challenges confronting the country at the moment.”

Sen. Jerry Moran, R-Kan., defended the bill, saying that it would help Afghan refugees.

Critics, however, note that the omnibus spending package contains 6,825 pages: 4,155 pages of legislative text plus 2,670 pages of explanatory materials to instruct agencies on how to carry out the provisions. It also includes at least 4,000 earmarks to pay for the pet projects of senators and representatives.

“With this vote, these Republican senators have committed a stunning act of betrayal of their constituents and the American people,” Stern told The Daily Signal. “With less than two weeks until the new Congress, they have shamefully voted to deny the incoming conservative House majority the use of its power of the purse to rein in Biden and his cronies.”

“This omnibus will add to inflationary pressures, saddling the nation with at least another $20,000 per household in needless debt and will expand the power of the woke Left,” Stern added.

Matthew Dickerson, director of The Heritage Foundation’s budget center, also slammed the Senate vote.

“This massive omnibus bill will cost taxpayers about $1.9 trillion next year at a time when American families are hurting from high inflation and the government is already $31 trillion in debt,” Dickerson told The Daily Signal. “It’s filled with woke earmarks and advances the Left’s big-government policy agenda.”

“The 118th Congress needs to be committed to reversing the growth of harmful government spending and inflation,” he added, referring to the Congress that convenes Jan. 3.

Heritage Action for America, the leading think tank’s grassroots affiliate, announced that it would mark a vote on the omnibus spending bill as a “key vote” for its legislative scorecard, urging all members of Congress to vote “no” on the bill.

Why it matters: Sinema has leverage and she knows it. Any potential modification to the Democrat’s climate and deficit reduction package — like knocking out the $14 billion provision on carried interest — could cause the fragile deal to collapse.

Driving the news: Sinema has given no assurances to colleagues that she’ll vote along party lines in the so-called “vote-a-rama” for the $740 billion bill next week, according to people familiar with the matter.

    • The vote-a-rama process allows lawmakers to offer an unlimited number of amendments, as long as they are ruled germane by the Senate parliamentarian. Senators — and reporters — expect a late night.
    • Republicans, steaming mad that Democrats have a chance to send a $280 billion China competition package and a massive climate and health care bill to President Biden, will use the vote-a-rama to force vulnerable Democrats to take politically difficult votes.
    • They’ll also attempt to kill the reconciliation package with poison pills — amendments that make it impossible for Schumer to find 50 votes for final passage.

The intrigue: Not only is Sinema indicating that she’s open to letting Republicans modify the bill, she has given no guarantees she’ll support a final “wrap-around” amendment, which would restore the original Schumer-Manchin deal.

The most likely scenario is that Sinema gets something in return from Schumer to make for smooth sailing for the bill. Democrats desperately need this or they may go into the midterm elections with literally nothing on their agenda accomplished.
