“Billy Erney Buitrago-Bustos stands accused of the most heinous and reprehensible of crimes,” Hyde said.

Despite failing to leave under visa terms since arriving at JFK International Airport in New York back in May 2016—and now facing grave charges—local law enforcement still seems hesitant when it comes to enforcing immigration laws effectively amid rising crime rates involving illegal immigrants like him.

However, countless localities have passed laws that strictly forbid their law enforcement from cooperating with ICE, which would include honoring immigration detainers. The data published by CIS suggests that sanctuary cities increasingly ignored detainer requests under the Biden-Harris administration, meaning more criminal migrants were released back into the community over the years.

There were 2,512 declined detainers in fiscal year 2021, beginning when Biden assumed office on January 20, 2021, according to the ICE data. There were 5,723 declined detainers in fiscal year 2022, 7,934 declined detainers in fiscal year 2023 and 5,871 declined detainers in fiscal year 2024 only up to the middle of July.

The number of criminal aliens freed into the country by sanctuary authorities could potentially be much higher given that, in numerous instances, local law enforcement releases criminal migrants before ICE is able to become aware of their apprehension and lodge a detainer request.

There are an estimated 17 million illegal migrants currently living in the U.S. as of June 2023, resulting in local law enforcement agencies having countless run-ins with individuals who do not hold lawful status. Since early 2023, ICE has lodged an average of roughly 10,000 immigration detainer requests a month, according to the Transactional Records Clearinghouse.

President-elect Donald Trump — who won office on a hardline immigration platform — has pledged to crack down on sanctuary cities, which could include withholding federal funds. However, sanctuary city leaders have so far expressed intense opposition to the idea of cooperating more with ICE agents.

Boston Mayor Michelle Wu said her police force would not be helping the president-elect’s expected plans for mass deportations, and Chicago Mayor Brandon Johnson pledged to resist the upcoming administration’s efforts to crack down on illegal immigration. Since Trump’s election victory, Los Angeles Mayor Karen Bass has been working with city officials to fast-track a bill that would enforce sanctuary laws in her city, and she hopes to have it passed before Trump makes it into office.

“We found ICE cannot always monitor the location and status of unaccompanied migrant children who are released from DHS and HHS custody,” HHS Inspector General Joseph Cuffari said in a memo to the deputy director of ICE.

“Without an ability to monitor the location and status of UCs, ICE has no assurance UCs are safe from trafficking, exploitation, or forced labor,” the alert states.

In response, U.S. Sen. Chuck Grassley, R-Iowa, requested additional information from HHS about UAC oversight, saying, “lax vetting has placed migrant children in grave danger of exploitation and abuse and makes locating these children after placement difficult, something I fear hinders the work of DHS as well.”

The DHS OIG report found that not only was ICE incapable of monitoring the location and status of all UACs but it was also incapable of initiating removal proceedings as needed.

ICE transferred more than 448,000 UACs to the care of the U.S. Department of Health and Human Services’ Office of Refugee Resettlement, which is responsible for their care, from fiscal years 2019 to 2023. Over the same time period, ICE neglected to issue notices to appear (NTAs) before an immigration judge for 65% of UACs transferred from DHS custody, according to the OIG report, leaving them in limbo.

Of the 448,000 UACs who illegally entered the country and were placed with sponsors through ORR, the majority arrived under the Biden-Harris administration: roughly 366,000, or 81%, between fiscal years 2021 and 2023, Grassley notes.

The report also found that ICE agents didn’t issue NTAs for immigration court hearings to all UACs who were flagged to be removed from the country, despite being required by federal law to do so, the OIG report found.

ICE failed to issue NTAs to at least more than 291,000 UACs who should have been placed in removal proceedings but weren’t, as of May 2024, according to the report.

“ICE was not able to account for the location of all UCs who were released by HHS and did not appear as scheduled in immigration court,” the report states.

At least 32,000 UACs who were given NTAs didn’t show up to their immigration court hearing and ICE doesn’t know where they are. Additionally, ICE didn’t always inform ORR when UACs didn’t show up, contributing to multiple agencies not being able to account for their whereabouts, the report found.

To make matter worse, ICE Enforcement and Removal Operations officers weren’t looking for them, according to the report.

Officers from only one of eight ICE ERO field offices that OIG staff visited said they attempted to locate missing UACs.

Federal agencies not scheduling immigration court dates appears to be a consistent problem, according to several audit reports.

From January 2021 to February 2024, one audit found that 200,000 asylum or other immigration cases were dismissed because DHS didn’t file paperwork with the courts in time for scheduled hearings, The Center Square reported.

Prior to that, 50,000 illegal foreign nationals released into the U.S. by ICE failed to report to their deportation proceedings during a five-month period analyzed in 2021, The Center Square reported. ICE also didn’t have court information on more than 40,000 individuals it’s supposed to prosecute, according to the report, and more than 270,000 illegal foreign nationals were released into the U.S. “with little chance for removal” during that time period, the report found.

Not knowing the whereabouts of the UACs “occurred, in part, because ICE does not have an automated process for sharing information internally between the Office of the Principal Legal Advisor (OPLA) and ERO, and externally with stakeholders, such as HHS and the Department of Justice (DOJ), regarding UCs who do not appear in immigration court,” the OIG report found.

ICE-ERO also hasn’t developed a formal policy or process to find UACs who don’t show up to their court dates, has limited oversight for monitoring them, and faces resource limitations, the OIG says. Nevertheless, “ICE must take immediate action to ensure the safety” of UACs and provide it with the corrective action it will take.

UACs who miss their court dates “are considered at higher risk for trafficking, exploitation, or forced labor,” the OIG says.

Earlier this year, Grassley led a group of 44 senators to introduce a resolution to reform ORR oversight after multiple allegations of sexual abuse of UACs were reported and more than 100,000 UACs appear to be missing, The Center Square reported.

Texas, California and Florida have received the most UACs of all states, The Center Square first reported, with each state receiving record numbers in fiscal 2023. For some states, fiscal 2023 numbers represent 20% or more of the total they received since 2015 or dwarfed previous years.

In 2018 – see below – Walz marched in an “Abolish ICE” protest in Minneapolis. This was before he locked down the state in 2020 over the Wuhan coronavirus (COVID-19).

Marchers alongside Walz called for elimination of all borders

An open borders guy himself, Walz participated in the “Families Belong Together” demonstration that year to oppose then-President Trump’s immigration policies.

That same year, Trump signed an executive order to keep families from being separated at the border, but Walz marched anyway to call for an end to family separation.

Many of the demonstrators at “Families Belong Together” could be heard shouting for the elimination of all borders period, which would be full globalism in motion.

Walz shared photos of himself at the rally on Facebook, praising himself and the others in attendance for using their voice to “tell the Trump Administration that families belong together.”

“Thousands of children and their parents are still separated,” Walz complained. “We won’t stop marching until they are united.”

To further show his support for illegal immigration, Walz signed into law legislation in Minnesota – watch below – that allows illegal aliens to obtain driver’s licenses, the same thing Kamala helped implement in California.

Failed presidential candidate for the Republican ticket Nikki Haley (R-S.C.) spoke out just moments after Kamala picked Walz as her running mate, stating that a Harris-Walz ticket is “a win for open borders, socialism, and Iran.”

Walz also created an “Office of New Americans” to make it easier and quicker for illegal aliens to flood the country and take whatever they can along the way while American citizens suffer.

“Kamala Harris and Tim Walz are two open borders, weak on crime, defund the police liberals who make up the most radical, far-left ticket in the history of our country,” commented Republican National Committee (RNC) chairman Michael Whatley in a statement.

Walz infamously stated about a week ago that he opposes Trump’s efforts to build a border wall while in office, promising to invest in a ladder factory should Trump get reelected and continue with those efforts.

“He talks about this wall, I always say, let me know how high it is,” Walz said on CNN. “If it’s 25 feet, then I’ll invest in the 30-foot ladder factory. That’s not how you stop this.”

Other benefits available to illegal aliens thanks to Walz include eligibility for Minnesota’s tuition-free college program, as well as for the state’s MinnesotaCare health care plan.

“My position on Minnesota becoming a sanctuary state boils down to who has the responsibility for enforcing immigration laws,” Walz told CBS News in 2018.

“Here’s what I believe: Congress has given federal agencies the authority to enforce immigration laws in Minnesota, and I support their doing so. Congress has not given local law enforcement that same authority. The role of law enforcement is to enforce state and local laws, not federal immigration laws, and I strongly believe that they should not do so.”

In March 2021, border officials began releasing immigrant illegals, asking them to report to the ICE office closest to their intended residence. However, the officials did not issue formal charging documents for these migrants. Charging documents require illegal aliens to appear before a federal immigration judge. ICE officials use these documents to locate and remove them.

In November 2021, the Biden administration implemented “Operation Horizon” to locate over 150,000 migrants released by the officials so that they can send official charging documents by mail.

However, ICE training videos released by Moody, which were recorded between November 2021 and February 2022, show that officials were quite restricted in their ability to locate and remove illegal immigrants as they lacked the identifying information of such aliens.

“Operation Horizon, the background on this … you know over the summer, we had well over 150,000 folks come in. They were issued a piece of paper that said, ‘find somebody in ICE,’ and that was pretty much it,” an official says in one of the training videos, according to a Dec. 20 news release by Moody.

“There was no processing. I know this isn’t something that you guys asked for, and I can assure you that no one in the criminal alien program asked for it either.”

Biden’s Mismanagement

The videos were brought to attention a day before the Title 42 policy was set to expire on Dec. 21. However, a Supreme Court Chief Justice delayed the expiry of the policy on Monday. The court is hearing pleas from multiple states who insist on keeping the immigration restrictions.

Title 42, which was invoked by former President Donald Trump in March 2020, allowed the administration to expel illegal immigrants entering the southern border during the COVID-19 pandemic. The Biden administration has been preparing to end the policy.

“If Title 42 ends, the administration may blame the mass surge of unvetted migrants on this rule’s remission, but don’t be fooled. They’re playing fast and loose with the lives of Americans to advance an absurd political agenda,” Moody said, according to the release.

“As our litigation uncovered, this has been this administration’s plan all along. They’ve let in and lost track of hundreds of thousands of inadmissible immigrants, and it will get worse if Title 42 expires. We will continue our litigation efforts to force Biden to follow the law and try to mitigate this national disaster.”

Illegal Immigration

According to data from the U.S. Customs and Border Protection (CBP), patrol officials reported over 2.37 million encounters in the 2022 fiscal year spanning from October 2021 to September 2022. This is up from 1.73 million in the 2021 fiscal year and 458,088 from fiscal year 2020.

At present, 30 percent of illegal immigrants are being returned back to Mexico under Title 42 powers, with the remaining being released into the United States under Title 8. According to Title 8 provisions, illegal immigrants are to be detained unless their immigration proceedings are completed.

In October, border officials processed around 81,500 illegal aliens under Title 42 and turned them back to Mexico. Meanwhile, almost 196,000 immigrants were processed under Title 8 and released into the United States. If Title 42 was not in effect, 30,000 of the 81,500 illegal aliens would have been allowed entry into America under Title 8.

In an interview with The Epoch Times, former CBP Commissioner Mark Morgan criticized the Biden administration for removing “any consequences of entering illegally.”

Ninety percent of illegal immigrants end up filing a “fake and fraudulent claim” for asylum. “We should not be releasing them in the United States … We should be detaining them,” he said.
