These articles accused Mayorkas of neglecting his duties at the southern border and breaching public trust.

The first article claimed that Mayorkas had “willfully and systematically refused to comply with the law” regarding the southern border during his tenure as DHS Secretary. The second article alleged that he had violated public trust.

Majority Leader Chuck Schumer, D-N.Y., proposed a point of order to deem the first article unconstitutional. Following Schumer’s proposal, the Senate voted 51-48 to declare it unconstitutional, with Sen. Lisa Murkowski, R-Alaska, voting present.

Schumer’s point of order was introduced after his request for unanimous consent, which would have set a specific time for debate among senators and votes on two GOP resolutions and a set number of agreed-upon points of order, was denied by Sen. Eric Schmitt, R-Mo. Schmitt argued that the Senate should conduct a comprehensive trial into the impeachment articles against Mayorkas, rather than following Schumer’s proposed plan, which would likely result in the dismissal of the articles.

Republican senators opposed Schumer’s point of order, as agreeing to it would effectively nullify the first article. Several GOP lawmakers made motions, including requests to adjourn or table the point of order, but all were unsuccessful.

“This process must not be abused. It must not be short-circuited. History will not judge this moment well,” said Senate Minority Leader Mitch McConnell, R-Ky., as he motioned to table Schumer’s point of order.

After further motions to avoid voting on Schumer’s second point of order, which would declare the second article unconstitutional, the Senate agreed to it in a 51-49 vote, with Murkowski rejoining the Republicans.

Gordon Sondland served as the U.S. Ambassador to the European Union from 2018 to 2020 and testified against Trump before the House of Representatives Select Committee on Intelligence in 2019, claiming that Trump sought to withhold foreign military aid to Ukraine unless it launched an investigation into then-former Vice President Joe Biden regarding his son’s business dealings in the country; Biden was running against Trump for the presidency at the time of the impeachment hearing. Sondland filed a registration statement with the U.S. Department of Justice, declaring himself a foreign agent of Ukraine and the E.U. in order to legally represent their interests in the country, according to a document obtained by the Daily Caller News Foundation.

Sondland’s registration is required under the Foreign Agents Registration Act (FARA), a 1938 law that governs how foreign governments and other entities may lobby U.S. officials. FARA registration is required regardless of U.S. citizenship and must occur before an individual begins lobbying.

“Was there a ‘quid pro quo?’ As I testified previously, with regard to the requested White House call and White House meeting, the answer is yes,” Sondland told the committee on Nov. 20, 2019, during a high-profile hearing that garnered international attention. “Everyone was in the loop. It was no secret.”

Trump, the presumptive Republican presidential nominee in the 2024 election, was impeached by the House of Representatives on Dec. 18, 2019, but acquitted by the Senate on Feb. 5, 2020. Shortly afterward, he dismissed Sondland from his ambassadorial position.

During his government service, Sondland personally dealt with high-ranking Ukrainian government officials such as President Volodymyr Zelenskyy. Since 2022, Ukraine has sought to lobby members of Congress and executive branch officials for support during its war against Russia.

Sondland defended his decision to register as a foreign agent in a telephone call with The Daily Caller News Foundation, describing it as a preventative measure to comply with FARA’s large scope, which he called “crazy.”

“This term ‘Foreign Agent.’ It sounds very sinister because that’s the way the FARA laws are written. You’re designated as a foreign agent. I’m not an agent of anyone. I haven’t been asked by Ukraine or the E.U. to represent them. I’m simply having conversations that everyone has all the time with members of Congress and with members of governments of other countries to try and bridge and divide,” Sondland told the DCNF. “The problem is the FARA laws require this registration and you become known as a ‘foreign agent,’ and that’s very different than someone who is hired by the E.U. or hired by Ukraine and paid to do a certain job on their behalf. I am not doing either.”

“My allegiance is still 100% to the United States, not to the European Union. Unfortunately, I can’t have these conversations without registering,” Sondland noted.

Sondland also pushed back against the belief that he provided testimony against Trump during the impeachment inquiry. “I relayed facts that occurred in 2019, some of which had the effect of having a negative…showing President Trump in a negative light and some showing President Trump in a positive light, but I had no agenda to testify against or for President Trump in 2019,” he claimed.

Before joining the Trump administration, Sondland was a developer and served as the chairman of Provenance Hotels, which owns a network of hotels across the United States. He donated $1 million to Trump’s inauguration committee in 2017, according to The Intercept.

The Trump campaign, the Ukrainian mission to the United States and the European External Action Service did not immediately respond to a request for comment.

“There weren’t any,” the president’s younger brother testified, according to a just-released transcript of his Feb. 21 deposition.

Jim Biden said he needed the money for “outstanding bills that I had.”

When asked whether Joe Biden was present for meetings with Tony Bobulinski, then a business associate of his son Hunter Biden, the president’s brother answered: “That I know did not happen.”

Jim Biden also testified that the contents of reported emails didn’t change his testimony or memory about his work with a collapsed rural hospital company, Americore Holdings.

The House Oversight and Accountability Committee on Friday released the 244-page transcript of the closed-door deposition, which is part of the impeachment inquiry into potential influence peddling by the president and his family.

The president’s brother became a key witness in the House probe after he and his wife Sara wrote a $200,000 check to Joe Biden on March 1, 2018, noting that the purpose was a “loan repayment.”

That $200,000 check was cut the same day that James Biden got a $200,000 payment from Americore Holdings.

Separately, the House committee released a copy of a $40,000 check written Sept. 3, 2017, from Jim and Sara Biden to Joe Biden that evidence shows may have been laundered through a Chinese energy company, CEFC China Energy, that Hunter Biden was involved in.

Several House members sat in on Jim Biden’s deposition, and several questioned him directly. At one point, Biden’s lawyer Paul Fishman said, “Calm down,” according to the transcript.

It isn’t clear whether the remark was directed at Fishman’s client or someone else.

“Have you ever made direct payments to your brother, Joe Biden?” Rep. Matt Gaetz, R-Fla., asked the president’s brother.

“I repaid two loans that I secured from my brother,” Jim Biden replied.

Gaetz followed up by asking: “And were any documents memorialized in terms of those loans?”

Biden, 75, seemed to stumble for words in answering the question.

“Through—through,” Biden said, according to the transcript. “Actual, no, no.”

Biden testified that the two checks—although made out to Joe Biden—actually went to lawyer Mel Monzack, who oversees the president’s business income such as book royalties.

“What was the full sum of those loans?” Gaetz asked.

“One was for $200,000 and one was for $40,000,” Biden answered.

Gaetz asked: “And what was the interest rate on those loans?”

Biden responded: “There weren’t any. … Yeah. Family. Uh-huh.”

Gaetz asked why he needed the $240,000 to begin with.

“Outstanding bills that I had,” Biden answered.

A House staff investigator asked the president’s brother about a recent Politico story about Americore Holdings. The investigator read from the article during the questions.

“Did you ever speak with anybody at Americore about Joe Biden getting equity in the company?” the investigator asked.

“That is ridiculous on its face. No,” Biden answered.

The Daily Signal first reported that Kentucky Attorney General Russell Coleman is investigating Americore Holdings, which operated in Kentucky.

The staff investigator continued, reading several references to the emails in Politico’s reporting.

The investigator began to ask:  “This appears to be an email. Do you recall referencing—”

Jim Biden cut him off, saying, “No.”

“Joe Biden?”

“No.”

The investigator asked: “Does this—quoting an email—does this change any of your other answers about never involving—?”

Again cutting him off, Biden said: “No.”

He later denied that Joe Biden ever met with Bobulinski, his son’s business partner at the time. Bobulinski already had told the House committee that he met with Joe, Hunter, and Jim Biden in California.

“Was Mr. Bobulinski what you would consider a business associate of you and Hunter Biden?” a House investigator asked.

“He wasn’t of mine,” Biden answered. “I had discussions with him, but there was never anything that was memorialized in terms of his involvement.”

The investigator asked: “Do you recall whether you were at the bar with Hunter Biden, Tony Bobulinski, and Joe Biden?”

Biden replied: “That I know did not happen. … I could have been there just with Tony Bobulinski. I could have been there with Hunter as well. But my brother was never there.”

Case for Impeaching Mayorkas Over Border Crisis Is Clear https://americanconservativemovement.com/case-for-impeaching-mayorkas-over-border-crisis-is-clear/ https://americanconservativemovement.com/case-for-impeaching-mayorkas-over-border-crisis-is-clear/#comments Sun, 04 Feb 2024 00:27:04 +0000 https://americanconservativemovement.com/?p=200935 (Daily Signal)—In considering the articles of impeachment against Homeland Security Secretary Alejandro Mayorkas, it’s appropriate for each House member to ask: Is his central role in precipitating our unprecedented immigration disaster and destroying the security and well-being of the American people tolerable and consistent with the rule of law?

It’s not. The grounds for impeaching Mayorkas are overwhelming.

What’s at issue in this impeachment is not just a policy dispute over how best to enforce the nation’s immigration laws. Mayorkas is actively nullifying and undermining those laws.

It’s no excuse for Mayorkas to say he’s just following President Joe Biden’s orders. And it can’t be the case that the House’s only proper option in the face of the current lawlessness is to impeach the president.

Biden and his White House advisers never could carry out this administration’s disastrous open-border agenda on their own. Biden can do it only through the active agency of a homeland security secretary who’s willing to abuse the powers of his department and violate the laws he’s sworn to uphold.

As a Senate-confirmed officer of the government, Mayorkas has a duty to follow the law faithfully; he should refuse to carry out directives that are inconsistent with the law, or else resign from office.

We are a nation of laws, and our republican government cannot function if the civil officers of the government are not held to account when they act in contravention of the law, even when they do so at the behest of the president.

Some may think that Biden will just continue with his current agenda notwithstanding impeachment, and simply put another willing lackey in place if Mayorkas were to be removed from office. But the president’s ability to do so would be much more constrained and subject to greater and more intense scrutiny by Congress and the public if the articles of impeachment are approved.

Border security never has been perfect and previous secretaries of the Department of Homeland Security have exercised some degree of enforcement discretion, including regarding parole and mandatory detention. But Mayorkas clearly has crossed the line of permissible discretion into flagrant nullification and violation of the law.

It is the proper constitutional role of the House of Representatives to declare that Mayorkas has gone far beyond what is tolerable and consistent with the duties and privileges of his office.

As Justice Samuel Alito made clear in dissenting from a recent Supreme Court decision holding that Texas lacked standing to challenge Mayorkas’ refusal to enforce the immigration laws, the House’s prerogative of impeachment is one of the only tools available to challenge this lawlessness, short of repudiation by the people in the next presidential election.

Some have raised the specter that if Mayorkas is impeached, it may become more common for the House to attempt to impeach Cabinet secretaries. But that’s a red herring.

Mayorkas’ gross misconduct and violations of the law are so extraordinarily extreme and intolerable that an impeachment in this case should not create a precedent that would become the norm going forward.

If anything, it should have the effect of discouraging such extraordinary misconduct by future Cabinet members. In any event, of course, nothing the current House does or doesn’t do will dictate how a future House may attempt to use its power of impeachment in other cases.

If Mayorkas is allowed to get away with the abuses and course of misconduct he has been guilty of, then it could be said that the House’s power to impeach civil officers itself would become a nullity.

He helped guide the policies that drastically reduced the number of illegal aliens crossing into the nation. Now, he has a different reason to be the ultimate border hawk.

When the Colorado Supreme Court declared Trump was ineligible to be on the primary ballot, Miller suggesting charging Biden with “insurrection” over his border policy.

As we noted from his Tweet yesterday:

Conservative officials must respond to the assault on Democracy in Colorado by removing Biden from the ballot for leading and engineering the insurrection on the border — a crime against the Constitution of such magnitude it defies comparison.

Now, he has penned a more detailed plan to take down Joe Biden as an insurrection by removing him from the ballot and impeaching him. For good measure, he included DHS Secretary Alejandro Mayorkas for good measure:

TO CONGRESS AND CONCERNED CITIZENS:

Joe Biden has an inviolable legal, moral and constitutional duty to defend our border — and to deter, detain and deport those who violate it.

Biden has willfully and lawlessly abrogated that duty and instead implemented, by choice and design, the largest resettlement scheme in the history of the world: mass relocating and releasing MILLIONS upon MILLIONS of illegals into our cities at an immeasurable cost in human suffering and human lives.

Child trafficking. Labor trafficking. Sex trafficking. The vilest abuse at an industrial scale. Torment and torture. Modern-day slavery.

Communities bankrupted. Hospitals drowning. Towns besieged. Police incapacitated. Schools overrun. Our children’s education shipwrecked. Our nation’s finances drained dry.

Kevin McCarthy, R-Calif., became the U.S. House Speaker when the GOP took the majority in the last election. But choosing him was not the first option for a number of stalwart conservatives who wanted Congress to fly closer to the Constitution.

So he cut a number of behind-the-scenes deals in order to gain their support.

But now the promises he made are being called out.

In fact, Rep. Matt Gaetz, R-Fla., has blasted McCarthy for not living up to his promises.

According to a report from Real Clear Politics, Gaetz put McCarthy “on notice that he is ‘out of compliance’” with the January deal that put McCarthy in the speaker’s office.

Gaetz said, “On this very floor in January, the whole world witnessed a historic contest for House Speaker. I rise today to serve notice. Mr. Speaker, you are out of compliance with the agreement that allowed you to assume this role.”

He insisted the House deserves a vote on a balanced budget, there should be full release of the January 6 tapes, there’s been insufficient accountability for the “Biden crime family” and he gave Biden too much in the budgetary process.

Gaetz said the alternative is a motion to vacate the chair – a direct challenge to McCarthy.

“Mr. Speaker, you boasted in January that we would use the power of the subpoena and the power of the purse. But here we are eight months later and we haven’t even sent the first subpoena to Hunter Biden.”

Gaetz then addressed the “power of the purse.”

“The only thing the 118th Congress is known for at this point is electing Kevin McCarthy speaker and underwriting Biden’s debt and unfortunately, there’s only one of those things we can remediate at this time.”

He said a looming vote for a budgetary continuing resolution would just keep giving Biden Green New Deal money.

“Mr. Speaker, we told you how to use the power of the purse. Individual, single-subject spending bills that would allow us to have specific review, programmatic analysis, and would allow us to zero out the salaries of the bureaucrats who have broken bad, targeted President Trump, or cut sweetheart deals for Hunter Biden,” he charged.

He added that Congress is facing a Sept. 30 deadline for the budget.

“I must be better. You must be better. And this House must be better, for it is the last best hope for tens of millions of Republicans. We demand real oversight against this weaponized government. Just look at the bribery. If tens of millions of dollars flowing from foreign corrupt people into the bank accounts of the Biden family wasn’t enough for actual impeachment, why were we even looking? Joe Biden deserves impeachment for converting the vice presidency into an ATM machine for virtually his entire family. We all see it, we all know it. ”

McCarthy did call on Tuesday for an impeachment inquiry, but Gaetz said that was jut a “baby step.”

He said he doesn’t know if votes would succeed. But he said “at least if we take votes, the American people get to see who is fighting for them and who is willing to tolerate more corruption and business as usual.”

He said, “I know that Washington isn’t a town where people are known for keeping their word. Well, Speaker McCarthy, I’m here to hold you to yours.”

Pelosi had nothing and rapidly moved to impeach President Trump twice. McCarthy has everything and is taking forever to impeach Joe Biden.

It’s telling that McCarthy’s latest statement about impeachment came late on a Friday. That’s the magic moment in politics when announcements are made or press releases are dropped to get them the least amount of attention from the media.

According to Breitbart, McCarthy is only going to launch an impeachment investigation into Biden once the House votes to do so. By comparison, Pelosi simply announced she was launching investigations and had an actual vote on it months later with the first impeachment of Trump.

Breitbart, which appears to support McCarthy’s strategy, posted:

House Speaker Kevin McCarthy made clear to Breitbart News on Friday that if House Republicans move forward with an impeachment inquiry into Democrat President Joe Biden, the move would come not as an announcement from him or anyone else, but from a formal vote on the floor of the House.

“To open an impeachment inquiry is a serious matter, and House Republicans would not take it lightly or use it for political purposes. The American people deserve to be heard on this matter through their elected representatives,” McCarthy told Breitbart News. “That’s why, if we move forward with an impeachment inquiry, it would occur through a vote on the floor of the People’s House and not through a declaration by one person.”

Doing so would require a majority—at least 218 votes, assuming the House is at full attendance for such a vote—of members of the House to vote for such a move. While opening a formal impeachment inquiry is not a vote to impeach the president, it is a massive escalation by the lower chamber of Congress towards doing so—and it would also provide the House with extraordinary new investigative and law enforcement powers in terms of compelling testimony, enforcing subpoenas, and digging into Biden’s behavior and the culture of corruption surrounding the president.

Let’s be crystal clear so there’s no ambiguity. The House GOP has bank records, plus a massive number of damning emails, text messages, and whistleblowers to prove beyond a shadow of a doubt that then-VP Biden and the entire Biden Crime Family participated in felonious crimes against America.

Pelosi had a single partisan whistleblower and a perfectly fine phone conversation when she launched her investigation.

As Bonchie at Red State noted, it seems like McCarthy is trying to run out the clock on the Biden presidency without launching an impeachment:

I hate to be the cynic here, but this is McCarthy taking an out on impeachment, likely ensuring it will never take place. By contrast, then-Speaker Nancy Pelosi announced the 2019 impeachment inquiry into Donald Trump from the floor.

All of this hemming and hawing by McCarthy and the House GOP is intentional. Whether to somehow enhance their own political careers or to defend the UniParty Swamp, they’re doing nothing but talking about impeachment. They’re pretending like they’re doing all of this talking as preludes to action when in reality they’re just talking in lieu of action.

And they’re probably going to get away with it. Why? Because far too few Republicans are demanding action now. Sure, we may hop on social media and whine about the feckless GOP, but there’s no real accountability. They’re on track to avoid impeaching Biden or at least delaying it until after the 2024 election. This is unacceptable.

IF there is an impeachment, it needs to be soon. The only way I see that happening is if the outcry from the people is loud enough. Even then, our representatives on Capitol Hill no longer listen to the will of the people. Perhaps they never really did, but at least they pretended in the past. Today, they constantly take actions that the people don’t want. They do this with no remorse. They do this with no fear of repercussions.

I’m hopeful that we can make our voices heard, not because I believe it’s true but because to accept that it’s not true is to acknowledge that our government is fatally flawed. Many already believe it is, but I’m not quite ready to accept that. Call me an optimist but I’m going to continue to scream at them until someone tells me to shut up.

The whistleblower informed Congress that Hunter Biden had invoked his father’s name to pressure a Chinese business partner through WhatsApp, even claiming that President Biden was present during the negotiations.

When asked about the point at which the investigation into Hunter Biden becomes an issue for the president, potentially leading to Republican-led impeachment efforts, Cruz responded by saying, “It is right now.” He further elaborated, stating that the WhatsApp conversation provided direct evidence of Joe Biden abusing his position to benefit his son and potentially himself. Cruz emphasized that the House should conduct an investigation into these allegations. He also highlighted the whistleblower’s claim that the Department of Justice, under Merrick Garland, hindered an investigation into the mentioned message.

It should be noted that Garland has denied any interference in the Hunter Biden probe. Senator Cruz made these comments during a recent episode of his podcast, “Verdict with Ted Cruz.” The discussion centered around allegations made by an IRS whistleblower, Gary Shapley Jr., who oversaw the investigation into Hunter Biden. Shapley asserted that there were unprecedented efforts to impede investigations into Joe Biden during the 2020 campaign and his presidency.

The whistleblower disclosed the existence of a WhatsApp message from Hunter Biden to Harvest Fund Management’s CEO, Henry Zhao, dated July 30, 2017. In the message, Hunter purportedly mentioned his father and used his name to exert pressure on Zhao to fulfill a commitment. The message stated, “And, Z, if I get a call or text from anyone involved in this other than you, Zhang, or the chairman, I will make certain that between the man sitting next to me and every person he knows and my ability to forever hold a grudge that you will regret not following my direction.”

Hunter Biden allegedly added, “I am sitting here waiting for the call with my father.”

Cruz emphasized that this WhatsApp message directly links Joe Biden to money originating from communist China. However, he acknowledged that there is a possibility that Hunter Biden may have been lying, and Joe Biden may not have been present or involved in any potential improprieties. Cruz argued that the lack of investigation into these allegations, as claimed by the whistleblower, constitutes obstruction of justice. He specifically pointed to Merrick Garland as potentially guilty of obstructing the investigation.

Cruz, a member of the Senate Judiciary Committee, expressed frustration that Democrats showed no interest in upholding the rule of law and holding a hearing to question Garland about the WhatsApp message and related matters. He asserted that the House is the only hope for pursuing an investigation.

If the claims made in the WhatsApp message are accurate, they would contradict President Biden’s repeated denials of any knowledge about his son’s business dealings. When asked about whether the WhatsApp message undermines the president’s claims, a National Security Council representative declined to comment further.

In response, a Hunter Biden attorney issued a statement claiming that any words or actions by Hunter Biden during his struggle with addiction were his own and not connected to his family. The White House Counsel’s Office also reiterated that the president was not involved in business dealings with his son and that the Justice Department independently makes decisions in criminal investigations.

Now he will move to trial in the Senate to determine his future.

Here’s his response:

The ugly spectacle in the Texas House today confirmed the outrageous impeachment plot against me was never meant to be fair or just. It was a politically motivated sham from the beginning. My office made every effort to present evidence, testimony, and irrefutable facts that would have disproven the countless false statements and outright lies advanced by Speaker Dade Phelan and the Murr-Johnson panel he appointed. Unfortunately, they refused to consider anything that would interfere with their desired result. They disregarded the law, ignored the facts, and demonstrated contempt for Texas voters.

Texas voters now know that Speaker Phelan and the corrupt politicians he controls are more focused on political retribution against conservatives than the welfare of the people. Instead of passing critical legislation that would strengthen our border, protect our elections, or stop the Chinese Communist Party from buying up Texas land, they chose to spend the final days of the legislative session smearing me.

Phelan’s coalition of Democrats and liberal Republicans is now in lockstep with the Biden Administration, the abortion industry, anti-gun zealots, and woke corporations to sabotage my work as Attorney General, including our ongoing litigation to stop illegal immigration, uphold the rule of law, and protect the constitutional rights of every Texan.

But the people of Texas know that I have always had their back, and in return, they have always had mine. What we witnessed today is not just about me. It is about the corrupt establishment’s eagerness to overpower the millions of Texas voters who already made their voices heard when they overwhelmingly re-elected me.

I am beyond grateful to have the support of millions of Texans who recognize that what we just witnessed is illegal, unethical, and profoundly unjust. I look forward to a quick resolution in the Texas Senate, where I have full confidence the process will be fair and just.

Paxton has been a target of multiple manufactured scandals over the years; nothing has stuck thus far.

But that’s not stopping the RINO-led Texas House from holding impeachment hearings this weekend against him. All it will take is a simple majority vote. Republicans have an 85-64 majority, so just a 11 RINOs are needed to get rid of him.

One month ago as reported by @mirandadevine in the NYPost, Paxton announced his new investigation into whether Pfizer, Moderna and Johnson & Johnson misled Texans on the efficacy and safety of their vaccines and whether they manipulated clinical trial data. Paxton was also looking into whether the pharmaceutical giants engaged in gain-of-function research.

Less than one month after this story came out the House brought impeachment proceedings forward.

Big Pharma’s stranglehold over Washington DC is well-documented, but they have as much if not more influence over state legislators where most medical decisions are actually made.

Is Ken Paxton being targeted because he’s going after the big-dollar puppet masters of the Texas Uniparty Swamp? Big Pharma’s political tentacles are long, numerous, and covered up by lawmakers and corporate journalists.
