This alarming assertion comes from a letter spearheaded by Rep. Thomas Massie (R-KY), signed by ten members of the House Judiciary Committee.

Massie’s letter follows troubling testimony from the DOJ’s Inspector General, suggesting that the FBI had confidential human sources (CHSs) present on the Capitol Grounds that day. It raises a critical question: is the DOJ intentionally slow-walking the release of this crucial report?

Joining Massie in this call for accountability are Judiciary Committee Chairman Jim Jordan (R-OH) and Reps. Ben Cline (R-VA), Chip Roy (R-TX), Andy Biggs (R-AZ), Victoria Spartz (R-IN), Barry Moore (R-AL), Dan Bishop (R-NC), Harriet Hagman (R-WY), and Matt Gaetz (R-FL).

The presence of federal assets, particularly CHSs, on Capitol grounds during the events of January 6, 2021, is a game-changer. It starkly undermines the establishment media and federal government’s narrative surrounding that day. Meanwhile, just blocks away, Trump faces federal charges from special counsel Jack Smith, who alleges that he orchestrated the chaos at the Capitol.

Massie’s letter serves as a reminder to Garland of his own words during his June 4, 2024 testimony.

Garland “testified that Inspector General Horowitz is ‘independent’ and ‘the determination of the release of Inspector General reports is up to the Inspector General.’”

“We write to remind you of your commitment,” the letter states.

On September 25, DOJ Inspector General Michael Horowitz testified before the House Weaponization Committee that the draft of the report is being held up by the DOJ.

This investigation had already seen delays during hearings held by Speaker Pelosi’s House Select Committee on January 6. Horowitz only resumed his investigation in 2023.

Now, the DOJ continues to drag its feet on prosecutions as the 2024 election looms, with several new cases emerging in recent months—over three and a half years after the events of January 6.

During the September 25 hearing, Horowitz confirmed that his draft report would indeed address the presence of CHSs. Massie pressed him for evidence regarding the number of CHSs operating on the Capitol grounds that day.

“Our report will include information in that regard,” Horowitz stated.

However, when pressed on the exact number, he replied, “I’m not in a position to say that, both because its in draft form, and we have not gone through the classification review, and so I need to be careful.”

Horowitz expressed a desire to issue his report soon but admitted that he does not expect it to be released before the election, indicating that the timing of the classification review is beyond his control.

Massie is not buying it and believes politics are afoot.

“Horowitz said the number won’t be known before the election. Biden-Harris doesn’t want the feds’ role on 1/6 known. Why?” Massie posted on X after the hearing.

Massie’s letter to Garland warns, “If you or any of your subordinates, associates, deputies, or agents within the Department act to delay or interfere with the release of this report, Congress will hold you accountable.”

If this report is ever released, it could drastically alter the prevailing narrative surrounding January 6. If Garland and the DOJ are found to have withheld this report until after the election, Congress may take decisive action.

Horowitz’s testimony strongly suggested that the report would contain explosive information.

Massie pressed Horowitz on how many confidential human sources entered the Capitol on January 6.

FBI protocols prohibit CHSs from breaking the law—entering the Capitol would certainly qualify, as made clear by numerous DOJ prosecutions—without express written consent.

“I’ll have that information in the report,” Horowitz replied.

Interestingly, when Massie inquired about how many CHSs were reimbursed for travel related to January 6, Horowitz responded, “as I sit here, I don’t recall the number,” before abruptly shifting gears and insisting, “and, if I did know it, I wouldn’t be in a position to tell you.”

The FBI operates under the DOJ, which ultimately determines what information is classified.

As the pressure mounts on Garland and the DOJ, one has to wonder: will the truth about January 6 ever see the light of day?

The fact that Biden and his attorney general, Merrick Garland, are using the imprimatur of the criminal justice system as a smokescreen to railroad and possibly imprison the leader of the opposition party is bad enough.  By treating President Trump’s speech as the “proximate cause” of other alleged crimes (consisting mostly of questionable trespass violations reimagined and inflated into felonies) committed by strangers, the Biden-Garland-Smith Triumvirate of Tyranny has turned every American’s opinion into a potential criminal act.

Should this bother all those rabid leftists who desperately want to see President Trump behind bars?  I would say so.  President Trump has now survived two assassination attempts, and although the FBI has done its best to muddy the waters concerning the motivations of the first gunman (trying to kill the Republican nominee for president seems like a pretty good clue, does it not?), the social media history of the second gunman (as well as the Biden-Harris bumper sticker on his truck) clearly exposes him as a Ukraine War–obsessed, anti-MAGA, Kamala Harris–supporting zealot who believes that President Trump is a civilizational threat.

Where would he get that crazy idea?  Oh, I don’t know — maybe from the constant stream of contributors on networks such as MSNBC who call Trump a “dictator,” another “Hitler,” and a “Nazi.”  Maybe the would-be assassin took Democrat politicians seriously whenever they showed up on news shows these last eight years to claim with utmost sincerity that Trump is a “threat to democracy.”

Maybe the man who turned an AK-47 on the president read one of the numerous opinion columns featured in the nation’s factually shoddy but stubbornly prominent publications, all universally libeling President Trump as a “rapist,” a “white supremacist,” a “fascist,” and a “dangerous” leader of the “far right.”  Should fake journalists who regularly claim that America will “literally end” if Trump returns to the White House be surprised when someone stumbles upon their neurotic rantings and subsequently attempts to “save” the country from the specter of their shared delusions?

Have we not also reached our “what’s good for the goose is good for the gander” political moment?  If President Trump must spend millions of dollars defending himself against mercenary prosecutors intent on locking him up for the remainder of his life because of the “dangerous” words that come out of his mouth, then surely those people who use their speech to beg for someone — anyone — to rid the country of the once and future president should be held similarly liable.  How many times can a Democrat politician or credentialed propagandist falsely compare Donald Trump to mass murderers and dictators such as Adolf Hitler and Benito Mussolini before those inflammatory slanders rise to the same level of “proximate cause” that prompted the Department of (in)Justice to put Trump in its crosshairs over January 6?

Jack Smith is prosecuting President Trump for somehow threatening the peaceful transfer of power from a legitimately elected president to an illegitimately installed stooge.  Even though Trump correctly believed (and still does believe) that the 2020 election was rigged in Biden’s favor (mail-in ballots stuffed into unsecured drop boxes in the dead of night, the use of Zuckerbucks to increase ballot collection in Democrat neighborhoods, and the Intelligence Community’s efforts to defraud the American people with regard to Hunter Biden’s “laptop from Hell” all amply support this conclusion), he left office as legally required on January 20.

Trump never called for violence against Joe Biden or the U.S. government.  He never urged Americans to revolt against their country.  Even on January 6 — the half-day of protest that leftist pundits and politicians say was worse than 9/11 and the Civil War combined — President Trump calmly urged his supporters “to peacefully and patriotically make your voices heard.”  In other words, he defended his First Amendment right to speak his mind and the First Amendment right of all Americans to speak theirs — but he never, ever called for violence against his political enemies.

For the crime of speaking truthfully about the tremendous deficiencies and suspicious vote-counting activities surrounding the 2020 election, Jack Smith and the rest of the Triumvirate of Tyranny have thrown President Trump in the dock to defend his life.  And as atrocious as the Triumvirate’s political persecution of an American president has been, it pales in comparison to the way it has harassed, hunted, imprisoned, and even tortured thousands of ordinary Americans for showing up at the U.S. Capitol on January 6, 2021 to protest for free and fair elections.

The vast majority of Americans who arrived in D.C. on that fateful day committed no crimes.  Most had no criminal records.  They included an inordinate number of veterans, law enforcement officers, grandparents, and retirees.  In D.C. courtrooms, however, prosecutors and partisan judges have described them as “terrorists,” “seditionists,” “insurrectionists,” and “domestic enemies.”

How did they earn such ignoble monikers?  They are accused of spreading the “Big Lie” that the 2020 election was stolen from President Trump.  It does not seem to matter to any of these courts that roughly 60% of the American people also believe that cheating likely affected that election.  For expressing an opinion unpopular in D.C., J6 political prisoners have been held in solitary confinement and forced to review “re-education materials” regarding Trump’s “lies,” “crimes,” and “attacks on democracy.”  These are actual lesson plans for conservative political prisoners in the United States.

If telling a “Big Lie” means that a person’s speech merits criminal punishment, though, surely Joe Biden and Kamala Harris deserve similar treatment.  Biden has repeatedly claimed that Trump-supporters murdered police officers on January 6.  That is a complete lie.  The only people to die that day were J6 protesters, including a female Air Force veteran shot in cold blood and another female beaten to death.  Crimes of murder and excessive force may very well have taken place on January 6, but Trump voters did not commit them.  That truth, however, is inconvenient for Biden, fellow Democrats, and their faithful media propagandists, who all desperately cling to the “Big Lie” that Trump engineered a “violent insurrection.”

Biden has also clung to the “Big Lie” that President Trump called neo-Nazis at a Charlottesville political rally “very fine people.”  Trump did no such thing.  He was discussing the issue of whether statues and monuments commemorating Confederate soldiers should be removed simply because they offend modern sensibilities.  In a moment when he sought to build unity among all Americans, he expressed his belief that there are good people on both sides of that contentious debate.  Trump warned, however, that once we start tearing down historic statues, the impulse to destroy our past will never end.  Eventually, he predicted, statues dedicated to George Washington, Thomas Jefferson, Abraham Lincoln, and other remarkable Americans would be targeted, too.  He was right.  Those who wish to transform America by first rewriting America’s history have spent the last four years toppling priceless monuments built by some of America’s finest artists.  But that truth does not permit Joe Biden to falsely portray President Trump as a “racist.”

Where have we heard the Charlottesville and J6 lies recently?  Kamala Harris repeated both during the presidential debate.  Surely, if President Trump is responsible for “inciting” a fake “insurrection,” Biden and Harris are responsible for inciting two very real assassination attempts.

That would be, according to that definition, a plan to take over the government, throw out the current leaders, assume control of the army, the policy, the foreign relations, debts, politics, courts, and more.

Of course, the protest-turned-riot was just that, a protest by those upset with the counted results of the presidential race, and the decision to give the White House to Joe Biden while there still remained many unanswered questions about the election.

In fact, there were two undue influences on the election, Mark Zuckerberg’s decision to hand out $400 million plus like candy to local election officials who often used it to recruit voters in Democrat districts, and the interference by the Department of Justice’s FBI, which falsely told publications that the Biden family scandals documented in Hunter Biden’s abandoned laptop were Russian disinformation and should be suppressed.

That facts have not prevented Democrats, and Democrat compatriots like ex-Rep. Liz Cheney, from proclaiming it WAS an insurrection, and claiming insurrectionists, including President Trump, not only must be charged and convicted, they must be prevented from ever being in office again.

Now that message is being hand-delivered to school-age children in Pennsylvania.

It’s through a “graphic novel,” or comic book, that is being published and handed out.

A Morning Call report said the publication insists students consider: “What would have happened if the Jan. 6, 2021, insurrection had been successful?”

The creators of the concept say they are mailing copies to all public high schools in the state as well as public libraries.

The report explained their goal is “to convey the risks facing American democracy, and what people can do about it.”

It’s authored by Harvard teacher Alan Jenkins and he said he wanted to make his opinions about that event available “in a widely accessible way.”

He has imagined, the report said, “a society controlled by armed militias who take over a TV network, declaring it to be ‘an enemy of freedom.’”

In fact, it is leftists across American academia, business and government who have tried to impose their own censorship schemes on America’s people and communications.

It also features a prominent Democrat lie that has been used against President Trump over and over, the claim he called KKK-type characters “very fine people,” when Trump specifically condemned that faction in his comments about a race dispute in Charlottesville.

A report at PJMedia explains the topic is one of the “inexhaustible supply of dead horses” Democrats have to beat.

“In the latest pathetic attempt to keep the J6 version of the ORANGE MAN BAD monster under their beds and scaring the base, the false J6 narrative has been reimagined in comic book form to help indoctrinate the high school kids,” the report said.

The report confirms, “There was no insurrection on Jan. 6, 2021. … The series of graphic novels are chock-full of lies from the Democratic Trump Derangement Syndrome fever dream. The Charlottesville lie is there, of course, and Black Lives Matter operatives are the good guys. The authors have enlisted the help of a radical organization to make sure the potential youth voters properly understand their marching orders.”

Ray Epps and his crew breached the Capitol perimeter at 12:53 p.m., minutes before the vote certification process in the House Chamber was scheduled to begin.

Minutes later, a parallel crew breached another lightly guarded barricade just to the south, the Capitol Police again offering no real resistance.

At 12:58, the so-called “fence cutter” – not yet arrested – pulled down the temporary fencing protecting the lawn and with it the signs saying, “area closed.”

Just about 1 p.m. a still unidentified man hung a noose from a gallows he and his crew of four had assembled hours earlier.

Minutes after 1 p.m. the Capitol Police discovered a pipe bomb set by an unidentified bomber outside the DNC offices near the Capitol. They checked after a comparable bomb had been found shortly before 1 p.m. near the RNC offices.

By 1:06 the undertrained and undermanned Capitol Police began launching munitions into the midst of a largely peaceful crowd of protesters on the Capitol’s west side, helping turn them into an angry mob.

In a tweet an hour later, Rep. Ted Deutch was the first to define the protest as “a violent insurrection. An attempted coup by Trump supporters at his encouragement.” Bingo!

As with any ambition plan, there were wrinkles. Ray Epps had made himself much too obvious. He might have to get his wrists slapped down the road. Finally, he did – a year’s probation, no biggie.

Vice President-elect Kamala Harris complicated matters by being at the DNC when the bomb was discovered. She’d have to keep her mouth shut about her presence, and the texts of her Secret Service detail would have to go missing, but these were tasks that could be (and were) taken care of.

A final complication: President Trump began his speech an hour late, at noon, not 11 a.m. as scheduled. Had he started on time, those thousands of people, allegedly incited by his rhetoric, would have arrived at the Capitol just about 1 p.m to help start a riot.

Not to worry. The House committee and Special Prosecutor Jack Smith just ignored the timeline. They accused Trump of inciting a riot that began 20 minutes before he finished speaking at a location 45 minutes away.

Like the others who actually heard Trump speak, Ashli Babbitt did not arrive at the Capitol until after 2 p.m. By this time, all external barriers had been removed.

Ashli entered the Capitol at 2:23 p.m. through an open window. At 2:44 p.m. Capitol Police Lieutenant (now captain) Michael Byrd shot and killed her without warning.

Say what you will about Byrd, but he was not part of the plan. From the planners’ perspective, he killed exactly the wrong person – a petite, attractive, unarmed female and a 14-year Air Force veteran to boot.

Worse, John Earle Sullivan, a rogue BLM-affiliated provocateur, captured the shooting on video and promptly sold it to CNN. The face of the protest was now the martyred Ashli Babbitt.

The conspirators could not let this stand. They needed a martyr of their own, and they set out to create one.

On the evening of Jan. 6, a rumor was floated that the protesters had killed a Capitol Police officer with a fire extinguisher.

Sara Carpenter, one of the women I profile in my book “Ashli: The Untold Story of the Women of January 6,” caught wind of the rumor while driving back to New York City on that fateful evening.

A medically retired NYPD officer, Sara called a Maryland friend thinking she might stop by. The friend freaked out. She accused Sara and her fellow protesters of a killing Capitol Police officer with a fire extinguisher.

Given that the woman’s husband was a retired Capitol Police officer, Sara believed her. She was crestfallen, heartbroken, physically ill. She could not get out of bed the next morning.

On Jan. 7, the conspirators caught a break. Capitol Police Officer Brian Sicknick died after suffering what would prove to be a pair of strokes.

Someone in authority – the New York Times would cite “two law enforcement officials” – made the conscious decision to have an officer who died of natural causes “murdered.”

On Jan. 8, the New York Times told its readers that “pro-Trump rioters” struck Sicknick with a fire extinguisher, adding this macabre detail: “With a bloody gash in his head, Mr. Sicknick was rushed to the hospital and placed on life support.”

Glenn Greenwald, an independent journalist, made a screen shot of the Times story before it could be revised. “This horrifying story about a pro-Trump mob beating a police officer to death was repeated over and over, by multiple journalists on television, in print, and on social media,” said Greenwald.

To sell the hoax, the conspirators had the ashes of the martyred Sicknick placed in the Capitol Rotunda and then buried with full military honors at Arlington National Cemetery.

To sustain the hoax, the conspirators had the autopsy report suppressed.

When finally forced out by a Judicial Watch lawsuit more than 100 days later, it was revealed that Sicknick died a “natural death,” meaning “a disease alone causes death.”

According to D.C. medical examiner Dr. Francisco Diaz, Sicknick suffered no internal or external injuries, nor any allergic reaction to a chemical substance.

The media chose not to notice, and the conspirators plowed on, now adding subsequent Capitol Police suicide deaths to the Jan. 6 death toll.

Said Attorney General Merrick Garland two years after the day, “And we will never forget the five officers who responded selflessly on January 6 and who have since lost their lives.”

Does it really get more ghoulish than that?

The Secretary of the Army lied and claimed he made calls to the National Guard, but he did not.

Former Speaker Nancy Pelosi and Washington DC Mayor Muriel Bowser were warned about the security situation before January 6th. Despite that, they refused troops at the US Capitol that day for political reasons.

Chris Wray’s FBI also refused to notify the Trump administration and his cabinet secretaries that they believed there could be violence like the mass protests at the Capitol that took place that day.

John Solomon from Just The News revealed Capitol Police were first warned about possible violence at the January 6th protests two weeks before the planned rallies.

They allowed the event to get out of hand so they could call it an insurrection and charge and arrest hundreds of people, mostly people who were let in by police or who walked in and out.

“I was concerned by the event that unfolded that day in the United States Capitol. As a Federal Officer of the United States Secret Service and former state trooper with the Florida Highway Patrol, my heart goes out to all law-enforcement officers, sisters, and brothers that held the line that day to restore public order to the chaos.

“I’m here today with my Counsel, Laughlin, McKillen, and Dan Meyer …has advised me, beginning with my role as a confidential source of the Select Committee to investigate the January 6 attack on the United States Capitol.

“When my confidentiality was breached, it was Dan who intervened to ensure I was protected as a military whistleblower on January 6. First, I want to explain my role on January 6. I was assigned as aide de camp, the personal assistant to major general, William Walker, the Commanding General of the DC National Guard.

“It was my only second day on the job. Please focus on alleged facts about found in the November 16, 2021, Department of Defense Inspector General’s multi-disciplinary review into the DC National Guard response and Department of Defenses role that day.

“I can say unequivocally that the inspector general’s review is riddled with inaccuracies, misstatements, perhaps false flags and narratives regarding how critical Pentagon senior officials responded when our Republic was under great stress.

“For instance, during a conference call at 2:31 pm with members of the United States Army, US Capitol Police, Metropolitan Police, the Department of District of Columbia government, and USC Service Uniform Division, US Army Lieutenant General Walter Director Pyatt, and US Army staff and the Army” Lieutenant General Charles Flynn, Director of the Chief of staff of Army Operations were on the call. Also on the call was Colonel John Lewis, Executive Officer to the Secretary of the Army.

“The Army falsely denied that General Flynn was ever on the call. This is false, immaterial on its face.

“Lieutenant Flynn was on the call and even participated in discussions. The Defense Inspector’s review also rounds language papering over the fact that Lt. Gen. Pyatt, Lt. Gen. Flynn, while on the call, discussed how they did not like the optics. That is a direct quote.

“And they stated it would be best military advice to recommend to the Secretary of the Army. Ryan McCarthy to deny request from Command General William Walker to deploy the DC National Guard and aid US Capitol Police and restore restoration order and border liberty on Capital Hill.

“In addition, former Secretary of the Army Ryan McCarthy claims he was on a 2:31 PM call and spoke on that call. This is false unless he was in the room, shadowing the call and he did not speak nor identify himself. He was not on the call.

“He was in route to Washington DC Regional Office at the Federal Investigations to support that concept of operation plan for January 6.

“He went on to claim that he called and spoke to Major General Walker at least twice, ordering the deployment in the DC National Guard. This is also false. At no time did General Walker take any calls, nor did we ever hear from the Secretary about any ongoing conference calls or the secure video teleconferencing throughout the day.

“This I know because I was with the Command General the entire time recording events throughout the day.

“Major General Walker told my staff officers to stand by with respect to deploy to the Capitol Hill. Only at 5:09 PM in the early evening, which I wrote down in my wheel book was the DC Guard given orders to deploy, move to assist Capitol Police.

“We arrived too late with one American lay dead with other sisters and brothers injured, including federal and local law enforcement officers. We were ready and standing by. I know if we were ready to deploy immediately when General Walker made the request, the National Guard could’ve helped in civil disturbance to restore order quickly.

“The Army National Guard motto was Always Ready, Always There. The DC National Guard was ready to help assist Capitol police, but we were not allowed to do our job due to paralyzed decision-making by Acting Secretary of Defense Chris Miller and Secretary of the Army, Brian McCarthy. This led to a crisis in federal leadership in the Pentagon. This led to a crisis in federal leadership at the Pentagon and delayed the DC  by three hours and 19 minutes. The videos were first identified by defendant William Pope of Topeka, Kansas, in court filings in his own Jan. 6 criminal case. Exhibits Mr. Pope originally filed under seal have become public since the release of thousands of hours of Jan. 6 security video by the Committee on House Administration Subcommittee on Oversight.

Two possible FBI special agents and a third unknown colleague were with John D. Guandolo, the FBI’s former liaison with U.S. Capitol Police, at the Women for a Great America event on the East Front of the Capitol on Jan. 6, 2021, according to Mr. Pope.

In sworn testimony in a December 2022 Alaska civil court trial and in numerous media appearances, Mr. Guandolo said he was with two FBI special agents and a colleague with whom he traveled to Washington on Jan. 6. Mr. Guandolo has indicated that he was also introduced to other FBI personnel at the Capitol that day.

Mr. Pope is seeking to compel federal prosecutors to identify them all. He said even if the men were at the Capitol on personal time, their free movement around the grounds shows they did not believe the Capitol was off limits to the public.

Mr. Guandolo, who handled counterterrorism and criminal investigations for nearly 13 years—from 1996 to 2008—as an FBI special agent, has said he was at the Capitol in a personal capacity and went primarily to pray.

He was interviewed by the FBI about his Jan. 6 visit on July 6, 2022. A heavily redacted copy of the FBI 302 interview summary has been made public.

‘This Is Huge’

Security video shows that as the crowd broke through the police line on the East Plaza and surged up the steps to the Columbus Doors, one of Mr. Guandolo’s colleagues clapped enthusiastically.

“Oh, oh, oh man, this is huge,” the man said, heard on Mr. Guandolo’s cell phone video that showed the crowd ascending the east steps.

On Capitol Police security Camera 7231, which looks out at the House Egg on the East Front, Mr. Guandolo was seen filming while standing on a chair just before 2:05 p.m. The clapping man, wearing a grey knit cap and dark coat, is identified in Mr. Pope’s court filing as “the Clapper” and “Colleague 2.”

While Colleague 2 cheered the protesters’ advance on the Capitol, a man on Mr. Guandolo’s left, “Colleague 1,” had his phone raised, presumably capturing his own video of the advancing crowd. He wore a brown knit cap and blue jacket, and carried a backpack, video showed.

Mr. Pope asked U.S. District Judge Rudolph Contreras to compel the Department of Justice to identify all FBI agents “who were material witnesses at the Capitol.” Mr. Pope wants the FBI “to produce all photographs, videos, and records related to their presence.”

The DOJ has filed opposition to Mr. Pope’s motion, saying it has “no obligation to investigate” who the men in the videos are.

Some of the exhibits in Mr. Pope’s Feb. 12 motion were redacted, but the recent release of thousands of hours of Jan. 6 security video by the Subcommittee on Oversight allows them to be released publicly, Mr. Pope said.

Capitol Police security video shows Mr. Guandolo, Colleague 1, and Colleague 2—often trailed by a third unidentified man, “Colleague 3”—moving about the Capitol grounds.

“For the record, my friend and colleague with me for most of the day on January 6th was not working,“ Mr. Guandolo told The Epoch Times in an April 2 email. ”He was there with his family to experience the event like most of us.”

Subsequently asked to clarify which of the men shown on CCTV he was referring to, Mr. Guandolo did not reply before press time.

“The other FBI guys I saw there I cannot speak about their capacity that day,” Mr. Guandolo added.

Mr. Guandolo said he testified for the defense in the criminal trial of Jan. 6 defendant Rebecca Lavrenz on March 29 and has been “asked to testify in several upcoming cases.”

Mr. Guandolo said his statements about Jan. 6 have been “very public and very clear.”

“There was an insurrection and revolution, and it was not done by the participants of January 6th but by senior government officials of the U.S. government,” he said.

‘Right to Be There’

The video from Mr. Guandolo and security cameras “also indicates that active-duty FBI agents perceived events at the Capitol to not be criminal,” Mr. Pope wrote in his motion. “From the clapping and celebratory expression we can conclude that these FBI agents were in favor of people accessing the building and that they believed the people had a First Amendment right to be there.”

At 2:28 p.m., Camera 7202 captured footage of Colleague 2 walking across the East Plaza and climbing the House steps. He stopped to shoot video or photos just a few feet from a group of Capitol Police officers, the video showed.

He appeared to be filming or photographing a group of five—two young men and three young women or teens—standing about a dozen steps above him. The five then descended the stairs and walked off camera with Colleague 2.

The group of five young adults was also seen walking immediately in front of Mr. Guandolo and his three colleagues on the House Plaza Egress—Camera 0811—at 2:55 p.m. and on Camera 0681 on the Southwest Walk at 2:57 p.m., video shows. One of the young adults carried on a conversation with Colleague 2 during part of the walk.

“Since this FBI Agent has professional law enforcement training, and since he found it permissible to walk up on the steps while three Capitol Police officers looked on nearby … it is reasonable for me to conclude that this FBI agent will provide favorable testimony about the permissive actions of police that is likely to sway a jury away from a determination of guilt,” Mr. Pope wrote.

At 2:32 p.m., an FBI tactical team drove onto the East Plaza in an MRAP (Mine Resistant Ambush Protected) vehicle. After the dark green vehicle was parked, Colleague 1 came from the area of the Women for a Great America event, walked around the front of the vehicle and spoke to someone inside the front passenger door for approximately five minutes, video showed.

“This could indicate that FBI Colleague 1 was indeed on the clock at the Capitol on January 6, or that the uniformed FBI SWAT team did not consider the events at the Capitol to be a pressing matter and that they had time to shoot the breeze with an off-duty FBI colleague,” Mr. Pope wrote.

Members of the FBI SWAT team were seen on security video entering the South Door of the Capitol just before 2:50 p.m. They immediately turned right down a side hallway and helped Capitol Police carry a mortally wounded Ms. Babbitt, who’d been shot outside the Speaker’s Lobby minutes earlier.

Ms. Babbitt was set on the floor near the south entrance and emergency care was provided by FBI medics and Capitol Police until paramedics from the District of Columbia Fire and EMS Department took over.

At about 2:55 p.m. Camera 0948 on the southeast roof of the Capitol showed Mr. Guandolo and his three colleagues walking away from the east steps. Camera 0811 on the House Plaza Egress sidewalk showed the men walking past just before 2:56 pm. Mr. Guandolo looked to his right and appeared to be speaking to someone just before he disappeared from view, Mr. Pope wrote.

A few seconds later, a man known only by the hashtag #FenceCutterBulwark walked into view from the opposite direction. The identity of #FenceCutterBulwark has been a longstanding mystery after he was shown on public video cutting down the green plastic security fencing erected by Capitol Police to keep crowds away from the Capitol.

Mr. Guandolo told The Epoch Times, “I do not know #FenceCutterBulwark.”

While he was carrying out his fence destruction, #FenceCutterBulwark was filmed by Metropolitan Police Department undercover officer Ryan Roe, who said to him, “Appreciate it, brother.”

A man claiming to be #FenceCutterBulwark appeared on the Patriot Punk Network podcast in September 2023, saying he was not a provocateur or a federal informant, and did not know Officer Roe.

“If he said, ‘Thanks, brother,’ then our, I’m assuming our exchange would have been, you know, me just basically saying, ‘Hey, I’m just trying to get this out of the way. It’s a hazard. It’s dangerous, or whatever. I don’t want people getting hurt,’” the man told Patriot Punk host Chase Matheson.

Mr. Pope has petitioned Judge Contreras to order the release of video shot by all members of the Metropolitan Police Department Electronic Surveillance Unit (MPD ESU) who captured video on Jan. 6 using cell phones, camcorders and GoPro cameras.

Nearly 30 ESU officers were assigned for duty on Jan. 6, organized into eight teams. Some of the men used their phones to live stream to the MPD command center, according to court records.

One of the undercover officers allegedly acted as a provocateur in the crowd on the Northwest Steps, according to previous court filings by Mr. Pope.

Officer Nicholas Tomasula confirmed in an interview with defense attorneys in the Proud Boys case that he was heard on Jan. 6 video chanting, “Whose House? Our House!” and “Stop the Steal!”

Mr. Tomasula was identified as “Officer 1” in Mr. Pope’s February 2023 motion seeking to make Officer 1’s undercover video public.

At the foot of the Northwest Steps, as a protester climbed up a makeshift ladder onto the balustrade, Mr. Tomasula shouted: “C’mon, man, let’s go! Leave that [expletive],” his video showed. Mr. Tomasula got help from a protester climbing onto the balustrade, then shouted to protesters moving up the steps, “C’mon, go, go, go!”

Mr. Pope said that Mr. Tomasula was not alone in encouraging protesters on Jan. 6.

“MPD’s internal investigation on Tomasula and my own research has identified that other undercover MPD officers were, in real time, praising protesters who broke windows at the Capitol and thanking persons who removed fencing,” he wrote in a motion on Aug. 21, 2023.

Mr. Guandolo and his three colleagues were seen on two security cameras on the southwest drive, passing by at 2:57 p.m.

“It is significant that there were several agents present. The testimony of these FBI agents who believed it was acceptable to be in this alleged restricted area will weigh favorably on the minds of the jury against any contrary testimony brought by the government,” Mr. Pope wrote.

“For this reason, the court should compel the government to identify all FBI agents who directly witnessed events at the Capitol since the exculpatory testimony of many, many agents will lend strength in numbers to my defense.”

President Trump made the comments in a statement on Truth Social on March 11, noting that it would be among one of his first acts upon taking office in the White House.

The Republican said shutting down the U.S.-Mexico border and increasing oil drilling as part of efforts to make America more energy independent would also be among his first actions as president.

“My first acts as your next President will be to Close the Border, DRILL, BABY, DRILL, and Free the January 6 Hostages being wrongfully imprisoned!” President Trump said.

President Trump said during a rally in Texas in 2022 that he would consider pardoning those convicted of their involvement in the Jan. 6 breach, noting that his administration would treat them “fairly.”

“If it requires pardons, we will give them pardons, because they are being treated so unfairly,” he said at the time.

Last year, President Trump told a town hall hosted by CNN at Saint Anselm College in New Hampshire that he was inclined to pardon a “large portion” of those charged with crimes relating to the breach.

However, the Republican stressed he would not pardon all of those imprisoned, telling the audience that “a couple of them, probably they got out of control.”

Jan. 6 ‘Hostages’

At a rally in Iowa on the third anniversary of the breach at the start of this year, President Trump referred to the individuals arrested in the wake of the Jan. 6 breach as “hostages” who had suffered enough.” He then urged President Joe Biden to release them adding: “You can do it real easy, Joe.”

President Trump’s latest comments mark the first time he has suggested that releasing those imprisoned over the Jan. 6 breach would be a top priority and that he will take immediate action to do so if he wins the November election.

According to the most recent statement from the Department of Justice (DOJ), more than 1,358 individuals from nearly all 50 states have been charged with crimes linked to the breach of the U.S. Capitol.

This includes more than 486 individuals who were handed felony charges for assaulting or impeding law enforcement.

Most recently, a 43-year-old Maryland man was arrested on felony and misdemeanor charges—including offenses of civil disorder and assaulting, resisting, or impeding certain officers—in relation to the events of Jan. 6.

President Trump himself has been indicted over allegations related to his actions on Jan. 6 and alleged attempts to challenge the results of the 2020 election, including conspiring to defraud the country and obstructing an official proceeding.

He has pleaded not guilty to the charges.

Trump Claim ‘False’

President Trump’s comments came on the same day that a Republican-led House committee released a report on its investigation into work done by a Democrat-dominated select committee that probed Jan. 6.

According to the GOP committee report, four individuals who served in the Trump administration did not corroborate testimony made by former aide Cassidy Hutchinson before the Jan. 6 committee in 2022.

Ms. Hutchinson, a former White House official, testified that she was told by Secret Service agent Anthony Ornato that he was informed by a fellow agent that, on the day the U.S. Capitol was breached, President Trump tried to grab the steering wheel of the SUV he was in after being told he could not go to the Capitol.

However, according to the Republican-led House committee, the Secret Service agent who was driving President Trump at the time of the breach denied the claim. However, this testimony was allegedly concealed by the Democrat-led committee.

“Despite the driver of the president’s SUV testifying under oath that the Hutchinson story was false, the select committee chose to validate and promote Hutchinson’s version of the story as fact,” House Republicans said in the new report.

“The select committee hid the driver’s full testimony and only favorably mentioned his testimony in its final report, it did not release the full transcript,” the report added.

The chairman of the Joint Chiefs of Staff (CJCS), Marine Gen. Joseph F. Dunford, was due to retire in 2019. Thus, Trump had to designate a replacement. For some reason, Trump was high on the U.S. Army chief of staff, Gen. Mark A. Milley, despite the advice, not only of Dunford but Secretary of Defense James Mattis, that Milley was not their first choice. Nonetheless, Milley got the nod and was sworn in as CJCS on Sept. 30, 2019.

During his confirmation hearings, Milley assured the Senate he would resign before doing anything improper, such as obeying an “illegal, unethical or immoral order,” and would never soft-pedal his advice to the president. Just before being sworn in as CJCS, he told Trump, “I will always provide you informed, candid, impartial military advice.” Trump responded with, “You’re my friend. You’re my adviser, and you deserve this position. I never had a doubt. Congratulations.” Based on the insights of a whistleblower who personally witnessed how the events of Jan. 6, 2021, at the U.S. Capitol unfolded, it appears Milley may have acted improperly, making the accolades given to him by Trump unwarranted.

A key issue concerning the January 6 incident is the National Guard’s failure to immediately deploy to stop the pro-Trump mob from entering the Capitol. But, instead, there was a four-hour delay. U.S. Army Col. Earl Matthews was in a position to know exactly what happened that day as he was serving as the National Guard’s legal adviser. But, after hearing two of Milley’s senior minions testify, allegedly contrary to what Matthews knew happened, he could no longer remain silent. In December 2021, he sent a shocking memo to the congressional committee investigating the incident.

The two senior officers involved were Gen. Charles Flynn, the deputy U.S. Army chief of staff, and Lt. Gen. Walter Piatt. Matthews held nothing back, accusing them of providing “perjured testimony.”

Despite his memo, Matthews was recommended for promotion to brigadier general in November 2022, only later to have it denied. This led to him filing a 37-page complaint on Jan. 3, 2024, claiming retaliation by the Army for blowing the whistle on his seniors. His complaint called them “absolute and unmitigated liars” in their testimony before Congress.

It was primarily due to testimony by the two generals that reports by both a Pentagon inspector general and the House committee investigating the January 6 incident found no impediment was deliberately placed by senior military leaders to delay the National Guard’s deployment. It is the Army’s narrative of the events of that day, supported by these reports, upon which the Colorado Supreme Court relied to justify getting Trump’s name removed from the ballot.

But in a recent interview, Matthews identified the person who delayed the Guard’s deployment, someone who had no authority to do so – Milley. Although the National Guard falls directly under presidential control, Milley circumvented his role.

Matthews made some fairly damning statements about the former CJCS in a recent interview. “Milley is the Don Barzini (a reference to the crime family in the ‘Godfather’ movie) of the Deep State,” said the Harvard Law School graduate. “He’s the most powerful chairman of the joint chiefs in history. It was Milley all along, and I didn’t realize it. Milley was manipulating this entire stuff from point start.”

Matthews shared that Milley projected himself outside of his authority. As CJCS, Milley was only to serve in an advisory capacity to the president with no legal authority within the chain of command. However, through his position and exploitation of other generals, he was able to maneuver himself into controlling the Army. Matthews explained:

“The problem was not with Donald Trump; it’s Mark Milley and the Army leadership in control. They stopped the Guard from coming, then lied about it and said the Guard acted at sprint speed. This is about civilian control of the military. There was none. There is none. I argue that – Mark Milley had more control over the D.C. Guard on Jan. 6 than Donald Trump did – if Donald Trump wanted to call the Guard to go to the Capitol, Milley wouldn’t let him do it.”

Among those supporting Matthews’ account are several District of Columbia law enforcement officials, including former Capitol Police Chief Steven A. Sund. He reported that the Pentagon seemed more concerned about the “optics” of military personnel engaged in crowd control as opposed to quickly deploying the Guard. He noted,”I got on a call with the Pentagon and pleaded for the National Guard. There was delay after delay after delay.”

Matthews reported once Sund’s request was received, it took more than three hours to receive the authorization to move Guard troops – who already had been equipped and pre-positioned – to the Capitol. He squarely faults Milley, stating, “I’m saying that his people delayed us, but Milley is in the center of everything, making the decisions – no question about it.”

Both Biden and Trump have leveled charges against each other that the other’s actions endanger democracy. What both should be demanding now is an investigation specifically into Milley’s actions for a rogue CJCS may well have violated his oath of office. If Matthews’ claims are accurate, they strongly make the case for a CJCS to have breached his constitutional authority, contrary to the clear intent of our Founding Fathers that the military at all times remain under civilian control. Absent such an investigation, Milley may well have gotten away with taking an unconstitutional walk on the wild side.
