It was unprecedented in scope.

We have personal experience in litigating these kinds of cases, such as when ACLJ Chief Counsel Jay Sekulow defended President Trump during the Mueller probe and presenting oral argument at the Supreme Court level. We’ve seen these Deep State tactics before, and they are on full display again.

Attorney General Merrick Garland appointed a Special Counsel to investigate Donald Trump’s keeping classified documents at Mar-a-Lago. He also appointed a Special Counsel to look into President Biden’s classified documents scandal – a Special Counsel we’ve heard nothing from.

But we’ve heard a lot from Special Counsel Jack Smith, the one leading the charge against Trump. And the ACLJ has had a long history with Jack Smith and his questionable legal tactics, especially during the 2013 IRS Scandal with Lois Lerner, in which we took the IRS to court and won. We sued the IRS after it targeted hundreds of conservative organizations and nonprofit groups – most notably Tea Party groups – with a BOLO (“Be on the Lookout) list leaving them in limbo for years. It really squelched their advocacy work.

We have evidence showing that Lois Lerner targeted conservatives. And who was involved in trying to prosecuted the IRS’s targets? None other than Special Counsel Jack Smith. Referencing a New York Times article about nonprofits incorrectly using campaign funds, an email from Jack Smith to one of his deputies, Richard Pilger, reads: “Could we ever charge a 371 conspiracy to violate laws of the USA for misuse of such non profits to get around existing campaign finance laws + limits?” In other words, Smith was looking for a novel legal approach to bring a conspiracy case against conservatives.

This continued for years. It was Smith’s same DOJ colleague, Pilger, who Lerner later worked with to “piece together” false charges against the Tea Party. Now we’re dealing with these same Deep State bad actors again today.

Lois Lerner later tried to slip in an apology at a legal conference for the IRS’s lawless actions in openly targeting conservatives, namely, the Tea Party. Lerner said, “We would like to apologize for that.” We said the apology was not accepted, and we went to federal court to ensure the IRS couldn’t keep targeting conservatives and were eventually victorious.

Those included many of the Tea Party groups, as well as many Christian organizations that shared a vision of fewer government burdens on their faith, and more.

Their appropriately filed requests for IRS tax status were delayed, denied and sometimes just ignored, with Lois Lerner, then director of the Exempt Organizations Unit of the IRS, pushing much of the agenda.

Now, years later, Americans apparently are going to discover what Lerner said in explaining the scheme.

It is government watchdog Judicial Watch that has announced a court has ordered the release of Lerner’s testimony, along with that of Holly Paz, her top aide.

The conservative organizations all were targeted just as Obama was running for his second term, and they wanted to be able to express opinions in opposition to the leftist president’s agenda.

The ruling from the U.S. District Court Southern District of Ohio, Western Division, came in a case brought by NorCal Tea Party Patriots, and concerned the depositions from Lerner and Paz that were ordered sealed by a judge in 2017, after lawyers for the two claimed they were being threatened.

Judicial Watch had joined the case with a friend-of-the-court brief supporting the request that the testimonies be revealed as they could “shed light on government misconduct … on the grounds that shielding internal government deliberations in this context does not serve the public’s interest in honest, effective government.”

The lawsuit eventually was ended when the government reached a settlement that included $3.5 million in payments to the various groups.

Judicial Watch reported, “In settling the case, the DOJ admitted the IRS abused its power and the criteria it used to screen applications for 501(c) status was inappropriate.”

But the testimony has remain concealed, even though then-Attorney General Jeff Sessions said, “The IRS’ use of these criteria as a basis for heightened scrutiny was wrong and should never have occurred. It is improper for the IRS to single out groups for different treatment based on their names or ideological positions. Any entitlement to tax exemption should be based on the activities of the organization and whether they fulfill requirements of the law, not the policy positions adopted by members or the name chosen to reflect those views.”

“Lois Lerner’s IRS was abused by Obama and his congressional allies to suppress the Tea Party movement and other opponents in the run-up to his reelection. This is how one steals an election in plain sight,” explained Judicial Watch President Tom Fitton. “The Obama IRS scandal was a run-through for the abuse of Trump in 2016 and beyond by Obama agencies and appointees. These depositions of Obama’s IRS officials will help Americans understand the continued clear and present danger of the IRS to our civil liberties.”
