Judge F. Dennis Saylor of the U.S. District Court of Massachusetts dismissed Mexico’s complaints against six major gun manufacturers, ruling that Mexico could not sue because they did not prove sufficient harm and none of the companies were incorporated in Massachusetts, according to the filings. The Mexican government alleged in a lawsuit filed in 2021 that the companies contributed to illegal firearms trafficking to Mexican cartels across the southern border from sales in Massachusetts through a Boston-based distributor, Witmer Public Safety Group.

“The core question for jurisdictional purposes is whether Mexico’s claims against the six moving defendants ‘arise’ from their business transactions in Massachusetts. As to those defendants, the connection of this matter to Massachusetts is gossamer-thin at best,” Saylor wrote. “The government of Mexico is obviously not a citizen of Massachusetts. None of the six moving defendants is incorporated in Massachusetts, and none has a principal place of business in Massachusetts. There is no evidence that any of them have a manufacturing facility, or even a sales office, in Massachusetts. None of the alleged injuries occurred in Massachusetts. No Massachusetts citizen is alleged to have suffered any injury. And plaintiff has not identified any specific firearm, or set of firearms, that was sold in Massachusetts and caused injury in Mexico.”

The six companies granted a dismissal are Barrett Firearms Manufacturing, Beretta U.S.A., Century International Arms, Colt Manufacturing Company, Glock, and Sturm, Ruger & Co, according to the filings. Smith & Wesson (S&W) and Witmer Public Safety Group were not granted a dismissal, as S&W was formerly based in Massachusetts before moving to Tennessee, according to Fortune, as well as Witmer Public Safety Group.

The lawsuit alleged that 342,000 to 597,000 guns made in part by the gun companies are trafficked across the border annually, according to the filings. They also alleged that after the 1994 Assault Weapons ban expired in 2004, there was an increase in guns manufactured and trafficked to Mexico.

Saylor said Mexico did not provide “sufficient proof” that the six gun manufacturers in question could be blamed for deaths caused by cartels in Mexico using trafficked firearms, according to the filings. Saylor added that Mexico has “no specific proof” that the companies in question sold “weapons to individual dealers in Massachusetts, and that some weapons sold by those dealers—although not necessarily those supplied by the six defendants—were illegally trafficked to Mexico.”

“Whether plaintiff might be able to establish personal jurisdiction over any of the six defendants in a state where it is actually located—or that otherwise has some reasonable connection to the pleaded claims—is not a question before this Court,” Saylor wrote. “For now, it is enough to say that the plaintiff cannot do so here. Accordingly, and for the following reasons, defendants’ motions to dismiss will be granted.”

In 2022, the lawsuit was dismissed by Saylor for the first time, ruling that Mexico’s claims against the gun manufacturers were barred by the Protection of Lawful Commerce in Arms Act (PLCAA), which protects gun manufacturers from some types of civil liability, according to the court filings. The lawsuit was revived in January 2024 when Judge William Kayatta of the 1st U.S. Circuit Court of Appeals overturned Saylor’s decision, saying that Mexico “plausibly alleges a type of claim that is statutorily exempt from the PLCAA’s general prohibition,” according to Reuters.

S&W, Beretta, Hilliard Shadowen, the law firm representing Mexico and the Mexican Foreign Ministry did not immediately respond to the Daily Caller News Foundation’s request for comment. Barrett, Ruger, Century Arms, and Glock could not be reached for comment.

“The (Mexican) Defense Department has warned the United States about weapons entering Mexico that are for the exclusive use of the US army,” Foreign Relations Secretary Alicia Bárcena said, who was quoted by AP News.

Bárcena said, “It is very urgent that an investigation into this be carried out.”

In June, the Mexican Army announced it had seized a dozen rocket launchers, 56 grenade launchers, and 221 fully automatic machine guns since 2018.

The influx of military-grade US weaponry entering Mexico comes as the Biden administration fails to secure the southern border as millions of illegals flood into the US. But what’s rarely discussed, in what seems like an Obama-era Operation Fast and Furious scandal, are weapons flooding Mexico from the US.

Last week, at the SHOT Show in Las Vegas, a Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) agent from a field office in southern Texas revealed to us that the agency is very concerned about a flood of 50 cal rifles and belt-fed machine guns that are illegally entering Mexico from the US.

The cross-border firearms trafficking of military-grade US weaponry on the southern border is very concerning. Lawmakers on Capitol Hill should investigate this worrisome development to ensure the Biden administration does not repeat the Obama-era Fast and Furious program.

America’s southern border is already a war zone, according to eyes on the ground. And this is the direct result of many decades’ worth of open-borders policies that have reached a pinnacle under fake president Joe Biden, who has left the southern border basically wide open for anyone to enter.

Since Biden was “inaugurated” in 2021, some five million illegal alien “migrants” have poured through and resettled here. And along with them are cartels like the one that now controls a 170-acre island in the middle of the Rio Grande River that contains sniper nests and is possibly booby-trapped.

Federal Border Patrol agents are doing what they can, but in most cases they are being completely overwhelmed by wave after wave of mass migration into the country, which has created a situation where Mexican gangs have slipped in unannounced and now have a foothold in the country.

America will soon be Mexico – and some would argue it already is

The aforementioned island, located about 250 miles south of San Antonio, is one such area of the U.S. that is now under the complete control of a Mexican cartel. And this is just one of many no-go zones that is popping up in the former “land of the free.”

Known as Fronton Island, the area in question hosts the Gulf Cartel and Cartel del Noreste (CDN), both of which are extremely violent. And keep in mind that they are using Fronton Island not to fight each other, but rather as a refuge for themselves whenever they have to flee either the Mexican military or American law enforcement.

As you might expect, the area these cartels control is also now a major drug trafficking corridor. The cartels use the thick vegetation in the area to stash their drugs while slowly making their way north into the rest of the country. Once they drop off the goods, they return to Fronton Island with more cash and weapons to add to their reserves.

These cartels do not value any human life that gets in their way. Whether it is law enforcement or an innocent civilian, they will shoot to kill whenever necessary to keep their operations going.

In 2019 before Biden was even in the White House, four cartel shooters with fully-automatic weapons fired more than 50 rounds from the Mexican side of the Rio Grande at a U.S. Border Patrol boat.

This past August, trail cameras captured grainy imagery of three suspected cartel gunmen armed with rifles and dressed in body armor crossing into Fronton from Mexico – this just a few months after five alleged Cartel del Noreste members, also donned in armor and tactical gear, were arrested in the very same area.

“It’s an island of death,” commented Jaeson Jones, a retired captain in DPS’s intelligence division who for years has fought against the cartels, and knows Fronton quite well.

“It’s dangerous, man,” he added, adding that the cartels are now cashing in on the ever-growing human smuggling business as well.

“The federal government is not able to cover all these areas and provide for the safety and security of landowners,” further commented Texas DPS Regional Director Victor Escalon.

“You have people out here saying, ‘Hey man, I’m out feeding my cows and I see three men coming across with backpacks and they’re armed. Why do I have to live like that?'”

Now, the U.S. Embassy in Mexico has issued a shelter-in-place warning for employees and citizens in the area.

The U.S. Consulate General Tijuana is aware of reports of multiple vehicle fires, roadblocks, and heavy police activity in Tijuana, Mexicali, Rosarito, Ensenada, and Tecate. U.S. government employees have been instructed to shelter in place until further notice.

According to the NY Post, this all started with gang wars at a prison:

The U.S. Consulate in Tijuana warned the public and government employees to avoid the area and seek shelter as violence and unrest erupted. The U.S. Consulate tweeted that vehicles are being set ablaze, roadblocks are being set up, and there is heavy police activity occurring in Tijuana, Mexicali, Rosarito, Ensenada, and Tecate.

At this time, all U.S. government employees have been instructed to shelter in place.

The violence began on Thursday in a Ciudad Juarez prison when the Sinaloa Cartel, formerly led by infamous Joaquin “El Chapo” Guzman, and Los Mexicles began feuding, leading to a riot that left two dead and 16 injured, according to the Times of San Diego. The violence then spread out of the prison and into the city streets of Juarez, where gang members killed an additional nine people, most of them civilians.

This does not appear to be random, uncoordinated violence.

Could this be more than a spontaneous war between cartels? Is there something else happening behind the scenes that could cause this eruption of violence to spread into the United States?
